JUSTICE FOR NICK! Robert L. Henderson, Jr. is in PRISON!

Greetings and Happy New Year!


It's been quite a while since I've sent an update and, I apologize. The last couple of months have been, to say the least, a lot. The weight our family has carried the last two years is immeasureably massive and has taken its toll on all of us. As much as I knew the website needed to be updated with the trial info, I also needed a break from the bleak monotony that's been our life since October 31, 2019.


I'm sure that most have heard the news - we finally had the trial for the murder of our beloved Nicholas.


Trial for Robert L. Henderson, Jr. began November 15. The jury selection was long and arduous, taking 2 full days (we're talking 'til 10PM!).


The trial was no walk in the park. We went every day. Hours of sitting, masked and 6 feet apart, in a hard chair in a cold warehouse - an EMC building space was used for our trial because the Courthouse was used for other Butts County hearings.


The videos were shown. The 911 calls were heard. Witnesses were examined and cross-examined. Experts told their findings and reports. The jury was watching and listening.


Tuesday, November 23, 2021, a jury returned their verdict.


The jury found Robert L. Henderson, Jr. guilty of Voluntary Manslaughter and Aggravated Assault.


Henderson, Jr. spent the holidays in jail.


Sentencing for Henderson, Jr. was held on December 8. Judge Mack sentenced him 20 years. 12 years in prison with no chance of parole and 8 years of probation, after release.


No, this isn't enough. Nothing will ever be enough because we will never get Nicholas back. But we're relieved to finally have some justice and the coward that committed this senseless act is finally locked up in prison!


A hearing has been scheduled for Antonio Evans, the co-defendent that flushed the bullet casing that fateful night. Evans refused the State's offer and prefers to be sentenced by the judge. The hearing will be February 2 at 1:30 PM at the Butts County Courthouse. It is open to the public and anyone may attend.

 

We're beyond thankful for our amazing Clayton County District Attorney team and Judge Mack. Our District Attorney, Bonnie Smith, is phoenominal and I cannot begin to say enough about how hard she and the team worked on this case and to get justice for my brother. They are kind and exceptional!!


Our family is extremely grateful for YOU! The love, prayers, thoughts, good vibes, texts, calls, meals, assistance and so much more that everyone contributed the last 2+ years -- WOW! THANK YOU. Our family can never express how much it all meant to us and helped us through. We felt your love while we were at trial, we needed it and you didn't let us down! Our sincerest gratitude to our family, friends, community and beyond. Thank you for hearing us, listening to us and helping us achieve some justice.



I hope that everyone had a wonderful holiday season, is having a happy new year and staying healthy. I will update regarding Evans' trial next month. Tomorrow, January 14, would be Nicholas's 30th birthday. I'll be celebrating with tacos, a cupcake and some SweetWater beers for my brother. He would love that.

Raise your glass and have a drink tomorrow for Nicholas. I wish he was here to celebrate with us, I know he'd have a blast! I miss him so much.
